Indemnity Form

Visitor Agreement:

I, the undersigned visitor, hereby understand and acknowledge that my participation in Earthchild Project activities involves certain risks, including but not limited to physical injury, property damage, theft, and other liabilities, particularly in relation to travel to and from the project locations, in areas such as Khayelitsha and Lavender Hill, which may present additional safety concerns.

Assumption of Risks:

I understand that as a visitor at Earthchild Project, I may engage in activities that involve physical exertion, travel to and from project locations, and interaction with children and members of the community. I acknowledge that there are inherent risks associated with such activities, including but not limited to accidents, illness, and unforeseen events during transportation, including potential safety risks associated with travel to and from specific areas such as Khayelitsha and Lavender Hill. I also acknowledge that the conditions of these areas may change at any time, which may necessitate adjustments to our schedule or itinerary and in cases where safety is not possible- cancellation of visits. I understand and accept that Earthchild Project does not assume responsibility for any risks or incidents that may occur during transportation to and from locations, whether provided by Earthchild Project or arranged independently by visitors. Earthchild Project reserves the right to cancel or modify the visit or itinerary at any time due to safety concerns or unforeseen circumstances. In such cases, I acknowledge that I may not be entitled to any compensation for changes or cancellations.

Release of Liability:

In consideration of being permitted to visit Earthchild Project, I hereby release, waive, discharge, and covenant not to sue Earthchild Project, its directors, officers, employees, agents, service providers, visitors and volunteers from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by me, or to any property belonging to me, while participating in Earthchild Project activities, whether caused by the negligence of Earthchild Project or otherwise.

Indemnification:

I agree to indemnify and hold harmless Earthchild Project, its directors, officers, employees, agents, service providers, visitors and volunteers from and against any and all liabilities, expenses, including attorney’s fees and damages arising out of or related to my participation in Earthchild Project activities, including but not limited to any incidents occurring during transportation to or from the locations.

Medical Authorization:

I confirm that I have informed Earthchild Project of any known medical conditions that may require emergency attention. I understand that I am responsible for taking any prescribed medication and necessary precautions to safeguard my health. I will not hold Earthchild Project, the school, or any associated stakeholders liable for any medical emergency resulting from my failure to do so.

In the event of an emergency, I authorize Earthchild Project and its representatives to obtain medical treatment for me if I am unable to do so myself. I understand that I am responsible for any medical expenses incurred as a result of such treatment.

Photographic Release:

I grant Earthchild Project the irrevocable and unrestricted right to use and publish photographs or videos of me taken during Earthchild Project activities for marketing purposes, without compensation to me. I acknowledge that I may take photographs and videos during my visit and that I am permitted to publish them. However, I agree to do so responsibly, ensuring that no content is shared in a way that could be harmful, defamatory, or inappropriate towards the school, learners, or Earthchild Project. I understand that if I publish or share any inappropriate content by any means, I may be held liable and subject to legal or criminal action.

I have carefully read this Visitor Indemnity Form and Waiver and fully understand its contents. I acknowledge that I am voluntarily agreeing to its terms and conditions.
